Re: Tort Reform From A Trial Lawyer's Standpoint

Wednesday, February 19, 2003

I am a trial lawyer, and I am very impressed that a person such as yourself, who presumably is not involved in the day to day operation of our legal system, has such valid insight into the system.

You are right on target - selecting the jury has a LOT to do with how a case comes out. I think your suggestion that only voters be allowed to serve is a very good idea and I agree with you wholeheartedly.

Also, I think it is kind of ironic that people such as State Senators Eric Johnson and Tom Price, and other "so tough on crime" politicians take the opposite viewpoint when an idiot who harms someone because of incompetence gets sued civilly; using their logic in criminal cases, we should be lighter on criminal defendants who fail to use personal responsibility.

This entire issue is about power:

1)Do we let the citizens keep their consitutional right to sit on a jury and render a meaningful verdict or do we let the legislative branch usurp their power

2)Do we take away a citizens 7th Amendment right to a fair jury trial and receive full justice for the harm done, or do we let big rich businesses and professions decide how much they should pay for their f***-ups?

Thanks for presenting the truth to your readers.
