    Bill, is a business required to register with the county and the state? Or does it vary by county and type of business?

    Hi, Steph

    It is my understanding that if the entity is a “domestic corporation” (i.e., incorporated in Georgia) it has to maintain that corporate status in order to protect its corporate name in the state in which it is operating.

    If the entity is registered as a corporation in another state, it is supposed to register in this state (and, it might be the same in other states) as a “foreign corporation” and pay annual fees to maintain its corporate status here.

    Additionally, whatever municipality that business resides in (whether a city or a county) it is required to hold a business license to operate there…and pay fees to help the county operate.

    I do not know if a penalty exists with the Secretary of State’s office regarding the failure of a company to register.

    If you’re conducting business you need a license. You also must file with the tax assessors office.

    Hmmm, wonder if he paid his taxes.
