Will The Real Kay Kirkpatrick Haltom Please Stand Up?
by Bill Simon
PRELUDE
Did you know that when someone in Georgia refers to the process of “registering to vote,” what you are really doing is applying to the State of Georgia for them to grant you a Voter ID Card? I conclude that by examining the explicit wording of this law, OCGA 21-2-417.1. Voter identification card. Because the majority of what this law instructs is what information is included on the State defined “GEORGIA VOTER IDENTIFICATION CARD.”
The application to register to vote/apply for a voter ID card can be found online here: https://registertovote.sos.ga.gov/GAOLVR/images/reg_form.pdf
AND, the very first requirement in the law to register to vote is to provide your “Full Legal Name.”
The problem with not registering under your actual legal name is covered under OCGA 21-2-561. False registration…where it specifies the following (which have been bolded in parts because you should understand exactly the pitfalls with falsely registering a name as an elector):
“Any person who:
(1) Registers as an elector knowing that such elector does not possess the qualifications required by law;
(2) Registers as an elector under any other name than the elector’s own name; or
(3) Knowingly gives false information when registering as an elector
shall be guilty of a felony and, upon conviction thereof, shall be sentenced to imprisonment for not less than one nor more than ten years or to pay a fine not to exceed $100,000.00, or both.”
So, let’s turn our attention to the
SENATE DISTRICT 32-SPECIAL ELECTION
Candidate Kay Kirkpatrick qualified to run for SD 32 on February 22, 2017 under the name “Kay Kirkpatrick” as per this extract from the Ga SOS site.
According to a phone conversation I had on the morning of 4/4/2017 with a woman named “Marlise” (sp? Not really sure of how her name is spelled, but that is what it sounded like) at the Cobb County Board of Elections, Kirkpatrick had just modified her voter registration the week before she qualified for this seat, on February 15, 2017.
What is the significance of this information? Well, up until February 15, 2017, the name Kirkpatrick was allegedly registered under as an active voter was “KAY KIRKPATRICK HALTOM”, that surname being that of her husband, who lives at that same address, and that name appearing to have been previously been registered back on August 1, 1986.
For the record, I have checked the Cobb County Superior Court Clerk’s site for a record of Kirkpatrick changing her Legal Name from the one with the last name of “HALTOM” to “KIRKPATRICK.” As of this Vine writing at 2:30 PM on 4/4/2017, I could not find a legal name-change case for her.
But, I will admit, I am not immune to making mistakes. So, if anyone wishes to see if they can find it, you are welcome/encouraged to visit that site here…and if you find a Legal Name Change case for Kay Haltom/Kirkpatrick, please capture it into a PDF/JPG file, email that to News@politicalvine.com, and I will issue an updated story to clarify the record.
If Kirkpatrick/Haltom did not actually file for a Legal Name Change in Cobb Superior Court prior to changing her Voter Registration Name, then she may be found to be in violation of OCGA 21-2-561. False registration.
Now, aside from the issue of Kirkpatrick’s potential legal hazard of changing her Voter Registration Name without (allegedly) changing her actual Legal Name through the Georgia Superior Court System, the purpose of this political sleight-of-hand appears to be an attempt to hide the fact that under the name HALTOM, “Kay Kirkpatrick,” who registered for this Special Election with the Republican Party, has a documented history of contributing money to multiple Democrats.
Yesterday afternoon, I received a rather large postcard that appears to be a good, clean hit piece on Kirkpatrick. Good and clean, because the piece communicates the fact that Kirkpatrick, under the name “Kay Haltom” loves her some Democrat candidates, dating all the way back to the time of when Democrat State Senator Liane Levitan represented DeKalb County in the Georgia Legislature.
More recently, Kirkpatrick/Haltom also contributed thousands of dollars to such notable Dems as US Representative Steny Hoyer (D-Maryland), Former US Senator Carl Levin (D-Michigan), US Rep David Scott (D-Georgia), US Senator Ronald Wyden (D-Oregon), and Former US Rep. John Barrow (D-Georgia).
The size of the postcard was massive…11″ x 17″….so big, I could only capture parts of it on my scanner, but the evidence is well documented as I checked-up on the contributions from “Haltom:” “Kay Kirkpatrick Claims to Be A Republican”
Lots of candidates to choose from in the SD-32 Special Election…one wonders, perhaps, if Kirkpatrick is actively playing both sides and sending mail showing her Democrat-chops to Dem voters, whilst stumping all over the GOP stronghold of SD 32 proclaiming her GOP-chops…multi-faced candidates have been known to employ such tactics before…
